Usual requirements for the building permit

You need a building permit for your structure because without it you cannot apply for electrical connection and water connection as they usually require it, and the Office of the Building Official (OBO) – the agency tasked to enforce the building permit – can also issue a violation against you, and they can even order a cease construction order, or worse a demolition.

Here are the usual requirements for the building permit application:

I. BARANGGAY CONSTRUCTION PERMIT. The baranggay level of government also has their own baranggay level ordinances and they need to check if your building and location is a suitable location for construction. They also need to check if you comply with the baranggay level ordinance on drainage and they also need to inform you of their garbage disposal procedures. They usually want to see a copy of your architectural blueprint, lot title, lot sketch plan, and the detailed bill of materials. Most baranggays have a flat permit fee which ranges from 800 pesos to as high as 5,000 like Baranggay Bankal in Lapu-lapu City – most expensive baranggay we know for securing a baranggay construction permit.

II. TAX CLEARANCE. You need to secure a tax clearance at the city or municipal assessor for that current year that you are filing application for building permit – which means you will need to pay the estate tax for that current year in advance. The tax clearance fee is only around 150 pesos to 350 pesos. The assessor will usually want to see a copy of your lot title, lot sketch plan, and an updated certified true copy of your tax declaration which you can secure from the same office.

III. CERTIFIED TRUE COPY OF YOUR LOT TITLE. You can obtain a copy of your lot title from your local registry of deeds from your local bureau of lands. The fee for obtaining a certified true copy of your title ranges from 278 pesos to 298 pesos per copy. They will usually want to see a copy of your tax declaration. Note that if your lot title is still under the previous owner’s name, the OBO (Office of the Building Official) will also need to see a copy of your Deed of Sale for that lot, and you will need to have the previous owner sign the consent section in the building permit application form.

IV. LATEST CERTIFIED TRUE COPY OF YOUR TAX DECLARATION. Aside from the title, the OBO will require a certified true copy of your tax declaration. They usually just want to check if your tax declaration data jives with your lot title and tax clearance. The fee for a certified true copy of your tax declaration is around 80 pesos to 120 pesos depending on your location as different cities of municipalities have different tariffs for processing of documents. To secure a certified true copy of your tax declaration, the assessor will require a copy of your old tax declaration of a copy of your title.

V. LOT SKETCH PLAN. The OBO will want to see your lot sketch plan signed by a registered geodetic engineer so they can check if you are building within your lot observing the required setbacks set forth by the Philippine Building Code. The geodetic engineer will want to see a copy of your lot title. The fee for a sketch plan ranges from 5,000 to 8,000 pesos depending on your location.

VI. BUILDING METHODOLOGY and SPECIFICATIONS. The OBO will want to see if you comply with the accepted methodologies and materials set forth by the Philippine building code. Be sure to follow what you write in your building specs as this document could be used against you in a court of law if you later they find out that you did not follow what you submitted. The building specs document has to be signed and prepared by a civil engineer. This usually comes free with the designing fee.

VII. BILL OF MATERIALS. The detailed bill of materials is primarily used by the OBO as reference in determining your building permit fee. Each municipality or city has a pre-determined tariff percentage for computing the building permit fee. You can expect a higher fee for bigger cities and lower fee for rural areas.

VIII. BLUEPRINTS. You will need to submit complete sets of architectural, electrical, plumbing, structural, mechanical, and electronics blueprints. You don’t need to prepare mechanical blueprints if you do not include air conditioner and elevator in your plans. You also don’t need to submit electronics plan if you did not include data, TV, telephone, and CCTV in your plans.

VIX. COMPLETELY FILLED OUT BUILDING, ELECTRICAL, PLUMBING, MECHANICAL, ELECTRICAL, ELECTRONICS, and ENDORSEMENT forms. You can get these forms at the Office of the Building Official (OBO). Be sure to completely fill out all required fields in the forms. Your engineers – civil, structural, electrical, plumbing, mechanical (if applicable), and electronics (if applicable) will also need to sign and seal these forms.

Different cities and municipalities – depending on your construction location might have additional requirements such as in Medellin of Cebu which requires an HLURB (Housing and Land Use Regulatory Board) clearance for lots located within subdivision lots. The HLURB fee ranges from 9,000 to 10,000 pesos. It is surprising to note though that other municipalities such as Consolacion did not require the HLURB clearance for a subdivision location. Additionally, some places like Medellin also require a DPWH clearance to make sure your structure is outside their no build zone which is usually 10-15 meters away from the middle of the highway.

    I built my house 6 years ago. Since then there has been regulation that was implemented regarding construction rules and regulations. I currently have a neighbor that is build their house on the side of my walls. I would like to know where I can begin to bring complaint regarding this matter.

      They can check if the neighbor have a building permit or if they followed the plans they attached in their permit application.

    Do we need a building permit from OBO even the structure is made from light materials ?
    because my client is renting in our property, the barangay asking a building permit from OBO before they will the certificate. . the structure is just made from light materials, and it just like an stall.

    1. Perhaps your area is strict, in most areas, they usually don’t ask for a building permit if you’re planning to build a bodega type temporary structure made of plywood or fiber cement. Perhaps if you can plead with the barangay and explain to them the purpose of your structure.

    Hi. Just want to clarify something po. We already have Building Permit but after releasing the building permit they will give us undertaking to comply all those necessary docs. My concern was they ask for water tank but our pre- fabrication cart is just 10sqm. Will you able to clarify us why we need to comply this.

    Hi,

    Almost all of what was written here is correct, but the owner should find for a Licenced Architect. It is the common misconception to find engineer because of public assumption. Architects are far better to training compared to engineers ,im speaking from experience when i constructed my house of 400 sqm.

    How much is the cost of the building permit in Iloilo City, with a Lot area of 46 sq.m, 2 storey house all concrete?

    Also, do we still need a building permit even though our Lot is only rights? Actually, we live in squatter’s area near the seashore.

      Without the tax declaration and title, you will not be able to secure a building permit since lot documents are the main required documents for a building permit. But if you can secure signature or consent from the land owner – it will be possible.

      45sqm building permit at city hall should be around p5-7k.

      Perhaps in your city like most cities nowadays, there are special considerations to get electrical connection, simply explain to your city hall building official the situation of your land, and they will instruct you a different set of requirements to get your electrical connection.

      If total 70sqm only, it should not exceed p20k for Bantayan Island.

      Better if you can bring your house layout plan and your title to the Municipal Engineer and ask them to quote for your building permit.

      We don’t quiet fully understand the situation of your building.

      What we know is that MECO wont allow a second transformer to the same account.

      To get your own transformer you will need another new account which will entail an entirely new electrical plan, or you can upgrade and replace the already existing one with a new higher rated one.

        If its no longer possible to demolish a portion of your structure, we can ask for a “variance” from your local government, and you will pay a fee for the variance, but only if there is no scheduled road widening in your area…

      Is it for 1 story or 2 story prefab structure?

      If it is for 1 story and you already have existing electrical supply for the units such as if it is only replacing an already existing structure, you no longer need a full blown blueprints.

      If it is a totally new structure and there is no existing electrical supply, yes you will need a full blown blueprints to be able to get new electrical connection and water. We can make you the complete blueprints with all the needed signatures and seals needed by the government to be able to acquire water and electrical connection for only p35k all in (if 1 level/story only) or p55k all in if 2 level/story structure for that size you specified…

      Yes we also accept construction only for your foundation works. Let us know the size of the area…

      We are planning to build a house on a lot owned by my grandparents who already died. The only document that we have is a tax dec under the name of my grandfather, can we secure a building permit using that and how? Thank you in advance.

      1. It will be close to impossible to get building permit if all you have is a tax declaration. All the building permits we process from different cities and municipalities they always require the title and even tax clearance.

        I strongly suggest, if you want to build without a building permit – you need to secure written consent from the rightful heirs of that land.

        1. Hi Rafa,

          If the planned fence is concrete, you will be required by the government to get a fencing permit because the fencing permit will require lot documents and a geodetic survey to make sure your fence stays within your property lines. The main point of the fencing permit is to make sure your fence do not go beyond your property lines, especially if the fence will be concrete because it is classified as permanent material. If your fence is just wood or anything lighter – the government might go easy on you since wood is considered as temporary or light material which can be easily corrected in case of property line complaint from the neighbors. Another reason to require fencing permit for concrete fence is to make sure the fence will be built with the correct structural design to make sure it is safe – since you will also be required a structural design blueprint among other requirements for a fencing permit.

    Hello. Do i still need building permit for an extension of space with concrete hollowblocks along the perimeter. This proposed plan is just 3meters from the existing house of the owner. He is planning to make it a rental. So he want a new electricity and water connection.

      Yes they will require you a building permit for 2 reasons on that:
      1. This new space is for commercial purpose, the existing house is for residential classification.
      2. It has a different entrance door and thus is a separate dwelling, not an extension which otherwise will not require a separate door from the main house.

    1. The current construction costs for all-in labor and materials around Cebu today is p25k per sqm for bare finish, p35k for standard finish, and p45k for luxury. Simply multiply each cost category with the total floor area of your planned house.

    1. we have not tried Apas yet. Rates could vary from p800 to p5000. e.g. Baranggay Bankal is p5000; Pagsabungan is 2,200… Rates could vary between extremes… You need to bring your blueprints to them so they can quote…

    Magkano po ba ang percentage that they will use to compute for fencing permit in Sibonga?kasi sabi ima sa rural?

    1. We don’t have the updated rates for Sibonga. I suggest you finish your fence blueprints first, then you can have the permit fee computed by the Sibonga municpal engineer. The rates for fencing permit is lower compared to building permit, and since Sibonga is not a city, they will have even much lower rates compared to cities.

    1. Soil boring test is usually only required for 3 story building or 2 storey roofdeck.

      IF you want to avoid it since it is usually very expensive, there is a way around it by changing something minor in your blueprint presentation even if you still want the two story roofdeck.

    Hi do we need to submit a lot sketch plan for building/fencing permit if it’s in an already existing subdivision? Or will the technical description in DOS suffice? Planning to renovate and expand foreclosed property acquired and seems developer does not have it.

    1. IT is a kind of bureaucratic procedure for the municipal / city engineer to ask for the lot sketch plan from you so they can verify your lot boundaries as they cannot source it themselves – they can only source it from you – as the permit applicant.

    1. The building permit is supposed to come before the building is constructed. So they won’t require it, they might charge you with penalties and might require building tax if you built it without building permit.

      The government fees depend on your Municipal or city classification.

      If you live in a big city, rates will be higher compared to if you live in a rural municipality.

      The best way to get your permit fees is to first finish your blueprints signed and sealed and then you can bring it to your city or municipal office so you can have it quoted for the fees.

You will need a building permit even for light materials for the following reasons: electrical connection application, water connection application, verification of the property lines of the lot you are using.     1. Yes go to the Zoning department first, then to the OBO (Office of the building official AKA municipal/city engineer). You will need to present your blueprints and lot papers…

            Have your blueprints signed and sealed by an architect or civil engineer, master electrician for the electrical plans, master plumber for the plumbing plans then submit it to the building official (city engineer) to start the building permit processing.

                The building permit is not just for water and electrical connection.

                They will require you building permit to check also on the lot boundaries – if you did not exceed your lot, the design of your structure if it follows the building code, and comply with the government fees for new structures.

    1. For light materials, for you to be able to get electrical connection from your local OBO (Office of the buildling official), they will simply require you a simple drawing of the structure. They will still require you some form of plans but it will be simplified since amakan is classified as light materials. They even have in their own office someone who can make the drawings for you for a very minimal cost…

        Depends on how strict they are, the barangay permit usually is just a requirement for the actual building permit…

    1. Your first step is your house drawings (architectural plans). You can contact an architect or even just a draftsman to design your house layout and exterior design.     Hi, Good Afternoon. I would like to ask if is it really need to process a building permit even if your house is a 12″x14″ one storey amakan house?

    1. Hi Ranolfo,

      You will not be able to get a building permit for Amakan because it does not qualify for permanent dwelling as it is a fire hazard material.

      But if you need a water connection or electrical connection, you can easily apply for it in your municipality or city by declaring your Amakan as temporary construction shelter for workers, by applying this way, you will be able to get water and electrical connection, however they will require you a building plans for the actual future house that will be constructed.

      I suggest you find a friend in your local city or municipal engineer who can help you get your water and electrical connection for the Amakan structure…

If it is not a two storey structure that you want to build, you don’t need a building permit, but if you are in a subdivision, they may require you to get one – depending on the subdivision rules. The reason they might require it is to check if your plumbing and electrical are done right as per Philippine building code…

      The house is by the way single storey inside a subdivision.

      1. Yes the subdivision will usually require you a city/municipal electrical and plumbing permit to make sure so they can see that you follow minimum plumbing and electrical standards on your new roof.

    1. There is no permit needed for repairs since there is no new structure construction involved but most subdivisions will require you to secure a subdivision permit and yes sometimes even a city/municipal electrical and plumbing permit to make sure those follow the minimum safety standards.

    1. You will need a building permit since a new structure is required for buildings more than 30 years. If no structural changes are involved then you don’t need a building permit.

    1. You don’t need building permit for renovations if – 1. you did not expand the area, and 2. you did not add an additional floor. You’ll be OK even if you did any of those as long as the neighbors will not complain due to dust or construction noise, or if none of the building officials notice your construction site…

    Good day!

    I am about to get a building permit for house construction. I was wondering, does the requirements vary from city to city?

    Also, does the architect/engineer oblige to provide us the number of copies per required documents needed by OBO without any extra charges? Given that they are the ones who designed / make the plan tho it is not stated in the contract that they will only provide X number of copies (standard plan, structural analysis, etc)…

    1. There is a vary slight variation between cities or municipalities because of some local ordinances, tariffs due to city or municipality class, zoning, etc.

      Usually the designer will provide all the copies you need but you will need to check the package you have in your contract – as the designing sometimes do not even include blueprint hard copies.

    1. Most municipalities are not very strict if it’s not 2 storey. But your municipality might be strict. To get building permit – you need title or tax declaration of the land, tax clearance, blueprints, and application forms.

    1. 200 meters is a very long distance, and that will result in a higher watthour reading in your electric bill. I suggest you apply a new connection for your store…

In Cebu City and most other cities or municipalities, they will require at least a cottage that looks decent – with a decent door and windows, and you need proof of ownership or authorization to build on the lot… If you are still starting a house construction, they can grant you a temporary electrical connection for construction purposes but they can only install it on the workers’ bunk house or decent hut…

Since the structure you plan to build is like a two story structure, since you have a concrete slab as roof deck, yes you technically need to have your plans signed by a structural engineer and approved by your local municipal or city engineer (building permit), but for structures like that – normally the government won’t mind, until a neighbor is disturbed by the noise and dust that comes with the construction, and he can complain to the local authorities – then you can protect your construction with a building permit…

        1. If the permit is already awaiting release, and you have sought permission from the office of the building official, and they have already made the pre construction inspection – then you may do so.

          Some cities or municipalities do not conduct pre construction inspection for residential projects – only post construction like Lapu-lapu City.

          Those places who expressly instruct you not to start construction before the permit is released – are the ones who usually impose penalties of p37-50k…

    Where do we report if we know someone is building a structure without building permit? Where do we report if the building being constructed does not comply with building code? This structure may collapse anytime and may cause serious injury or death. Please advise or forward to proper authorities. Thank you.

    1. You may request for an inspection from your city or municipal engineering department / office of the building official (OBO) or from the Mayor’s office as the mayor is the one who issues permits after a structure or plan is inspected by the city or municipal engineer.

    Are we allowed to build additional structures without building permits? Are we allowed to add more piles of hollow blocks to an existing old and dilapidated wall which may collapsed anytime?     1. If the height of the structure is above 2 meters and is built outside of an area with current permit – then you need new permits.

      IF there are new electrical and plumbing installations – then you will also need electrical and plumbing permits.

      If the old structure is more than 25 years and visibly crumbling then it needs to be replaced with new.
