My question Admin is that, for the former which is classified as A&D Land, can we already proceed to the application of Title for such portion since it is classified as A&D? And as far as I can remember during the Inspection and Verification when we submitted the Application of Survey to the DENR, the DENR officer somehow told us that we can also apply for a conversion of the TIMBERLAND Portion to also be A&D classified Land, which details are shown in the latter as above-mentioned, but he said that such process needs to be done in the House of Congress, then later on the Senate and to be approved by the President. If we will apply for the conversion of such TIMBERLAND, as for your own opinion Admin, will it be possible? As for now we are trying to reach the Congressman in our area/district so we could ask him if he may be able to help us with such concern. I will wait for your response and advice to my concern Admin. Thank you very much!

Yes you can already process the titling of that lot which DENR admitted and declared as regular alienable and disposable land.
For the portion they declared as timberland – yes the regular procedure to convert it to A and D is through your congressman. For your own safety, I recommend you write the formal letter addressed through your congressman through a lawyer with experience in land procedures. This is not to be suspicious of your congressman, but by writing him/her through a lawyer, your rights will be protected, as we all know some of our politicians are very good in land grabbing. Once you have the letter written through a lawyer, simply have it received by the congressman’s secretary. The previous president Duterte has already trained government officials to respond swiftly from requests of people, thus it is expected your congressman should also do the same. Have a second copy of that letter stamped as “received” by the congressman’s secretary and that copy will serve as legal basis of your request and for you to keep following up with your congressman.

Balak Sana namin mag Tayo nang maliit na bahay malapit sa bahay nang Magulang namin.at Yung area na po Yun ay Yung mga magolang namin nag cultivate nang ilang dekada Napo. Ang problema po pinagbawalan kami mag tayo nang bahay. May batas na po ba na pinag babawal na galing sa Denr po bawal na Napo mag Tayo nang bahay Yung mga Tao nakatira Ang nag cultivate nang Lupa sa loob na ilang dekada ?may nag pupunta Kasi sa island of gibitnil na taga Denr daw po siya. At pinag babawalan na Yung lahat nang Tao na mag Tayo nang bahay. At sinisingil din kami nang tax dec Doon without reciepts po na binibigay.
Main purpose Lang Naman namin is para may matirhan at matulogan at for safety narin.

If it is declared timberland or protected by DENR, no construction will be allowed on it and DENR is mandated by law to protect such land, but some residents have found a way around it and we’ve seen it all the time…. They build huts or cottage type dwellings made of wood or cheap materials and the DENR rangers will not make a fuss about it… In most timberlands we’ve seen – the DENR rangers will only make an issue of it if you build a concrete structure, but if you build something weak like a cottage design or a hut design they will leave you alone… At least that is what we’ve seen out there…

If the Old houses were built before they enforced the forest protection law, then they were free to build.
Also some areas are recently classified as timberland, so if your area was recently classified – then they did not enforce the restriction until it was classified as timberland.
They certainly will not allow new builds anymore.
Stay low profile – build a shack or a cottage – something temporary looking – that’s what other’s did….

Hi! Hoping you can help with a family problem. We are trying to sell our property. We requested for an A and D Certification and found out that it was classified as Timberland. We were informed that we cant sell the property. What puzzled us is that all other properties surrounding our property was sold. Is there a way for the property to be reclassified, so that we can sell it? We badly need your help. We don’t know where else to go.

You can sell your stewardship rights on that timberland by surrendering your tax declaration to the new owner – thru a knowledgable lawyer. When an amount is decided and paid and accepted by you for that rights on the tax dec then the buyer becomes the new steward. That’s how they sell timberland. They also don’t tell the buyer that they can’t transfer the tax dec to their name. Agents sometimes also hide this fact by telling prospective buyers that there is a freeze on transfers for that area. The classification can only change when your congressman passes a law to re classify that area.

Unfortunately you cannot make changes to the entries of the tax declaration of a timberland as it is government protected…
Yes you can apply for SLUP (Special Land Use Permit) which is a temporary annual permit for you to use timberland under very strict parameters set by DENR and in which you will agree to pay annual rent… Your rent depends on the size of the timberland… The cost to process it is no joke as you will have to undergo several other government offices and you need to make a lot of legworks, and when you get to the part where you will need to hire an experienced DENR consultant to write your thesis plan – the consultation fee could go at least p100k… It was p80k here in the Visayas before the pandemic…
